6. Lawful Bases for Processing

Depending on the context, we rely on one or more of the following lawful bases:

  • Consent: where you voluntarily submit a form, opt in to marketing, accept non-essential cookies or otherwise consent to specific processing.
  • Contract or steps requested before a contract: where processing is needed to provide a quotation, fulfil an order, deliver and install a product, honour a warranty or provide support.
  • Legitimate interests: where reasonably necessary to respond to customers, operate and improve our business, secure our services, prevent fraud, keep appropriate records or measure advertising effectiveness, provided those interests do not override your rights.
  • Legal obligation: where processing is required for accounting, tax, consumer protection, regulatory, law-enforcement or other legal requirements.
  • Protection of vital interests or another lawful basis: where applicable in exceptional circumstances permitted by law.

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing already carried out lawfully before the withdrawal.

7. Marketing Communications

We may contact you about the enquiry, quotation, product or service you requested. With your consent, or where otherwise permitted by law, we may also send information about AquaGuard products, services and offers.

You may stop promotional messages at any time by:

  • using an unsubscribe option provided in the message;
  • replying “STOP” or asking us to stop through the same communication channel; or
  • contacting us using the details in Section 2.

Service, order, installation, warranty and security communications may still be sent when necessary to provide a requested service or fulfil a legal obligation.

8. Cookies, Analytics and Advertising Technologies

Our website may use cookies, pixels and similar technologies to operate the site, remember preferences, understand site usage, measure advertising performance and provide relevant advertising.

These technologies may be provided by third parties, including website-hosting, analytics and advertising platforms. Where required, we will request consent before using non-essential cookies. You can also manage cookies through your browser or device settings. Blocking some cookies may affect website functionality.

9. How We Share Personal Data

We do not sell personal data.

We may disclose relevant personal data only as reasonably necessary to:

  • delivery, installation, maintenance and authorised service personnel;
  • professional advisers such as lawyers, accountants, auditors or insurers;
  • regulators, courts, law-enforcement bodies or other authorities where required or permitted by law;
  • a buyer, investor or successor in connection with a genuine business reorganisation, merger, financing or transfer, subject to appropriate safeguards; and
  • another party where you direct or authorise us to share the information.

Service providers are expected to process personal data only for authorised purposes and to apply appropriate confidentiality and security measures.

10. International and Cross-Border Processing

Some platforms and service providers we use may process or store personal data outside Nigeria. Where personal data is transferred internationally, we will take reasonable steps to ensure the transfer has a lawful basis and that appropriate protection is applied, as required by applicable law.

Third-party platforms may also make independent international transfers under their own privacy policies. You should review the privacy information provided by any platform you use.

11. Data Retention

We retain personal data only for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining warranty and transaction records, resolving disputes, enforcing agreements and meeting legal obligations.

As a general guide:

  • enquiry and unconverted lead information may be retained for up to 24 months after the last meaningful interaction;
  • marketing information is retained until you opt out, consent is withdrawn or it is no longer needed;
  • order, payment-confirmation, installation, maintenance and warranty records may be retained for the applicable service, warranty, accounting, tax, dispute and legal-retention periods; and
  • information needed for fraud prevention, security or legal claims may be retained for as long as reasonably necessary for those purposes.

We may retain anonymised or aggregated information that no longer identifies you.

12. Data Security

We use reasonable administrative, technical and organisational measures designed to protect personal data against accidental or unlawful loss, alteration, disclosure, destruction, misuse or unauthorised access.

Access to personal data is limited to persons and providers who need it for legitimate business purposes. However, no internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

If a personal-data breach occurs, we will assess it and provide any notification required by applicable law.

13. Your Data-Protection Rights

Subject to applicable law and any lawful limitations, you may have the right to:

  • be informed about how your personal data is processed;
  • request access to personal data we hold about you;
  • request correction of inaccurate or incomplete personal data;

If you believe a child has provided personal data to us, please contact us so that we can review and, where appropriate, delete it.

15. Third-Party Websites and Platforms

Our website or communications may link to third-party websites, payment services, social networks or messaging platforms. Their privacy practices are governed by their own policies. AquaGuard is not responsible for the privacy practices of independent third parties, and we encourage you to review their privacy information.
